Terms of Service (ToS)

1. Scope of Application

The business relationship between the Provider and the Customer is governed exclusively by the following General Terms and Conditions in the version valid at the time of the order. Deviating conditions of the Customer are not recognized unless the Provider expressly agrees to their validity in writing.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. By clicking the "Buy" / "Submit Order" button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order follows immediately after sending the order and does not yet constitute acceptance of the contract. The contract is only concluded when we accept your order by sending an order confirmation via email.

3. Prices and Payment

• All prices are in Swiss Francs (CHF) and include statutory Value Added Tax (VAT).
• Shipping costs are charged separately and shown during the ordering process.
• Payment can be made via Credit Card, TWINT, or Invoice (subject to credit check). The Provider reserves the right to exclude certain payment methods in individual cases.

4. Delivery and Transfer of Risk

Delivery is only made to addresses within Switzerland and the Principality of Liechtenstein. Unless otherwise stated, the delivery time is 2 to 5 working days. Benefit and risk pass to the Customer upon handover of the goods to the carrier.

5. Right of Return

Since Swiss law does not mandate a general right of withdrawal for online commerce, Mama’s Shop voluntarily grants a right of return of 14 days from receipt of the goods. Conditions for return are:

• The goods are unused, undamaged, and in their original packaging.
• Return shipping costs are borne by the buyer, unless the goods were delivered defective.
• Food items and personalized articles are excluded from return.

6. Warranty

The statutory warranty provisions according to the Swiss Code of Obligations (OR) apply. Defects in the delivered goods must be reported to the Provider as soon as possible. The Provider decides at its own discretion on repair, replacement delivery, or refund of the purchase price.

7. Liability

Mama’s Shop is liable only for direct damages caused by intentional or grossly negligent acts. Any further liability, particularly for indirect damages or consequential damages, is excluded to the extent permitted by law.

8. Applicable Law and Jurisdiction

Swiss law applies exclusively. The place of jurisdiction is the registered seat of the company.
